Aviva Michelman-Dumas is a New York City arts and entertainment attorney with a background in litigation. She represents clients in the arts, tv/film, theatre, publishing, and media industries reviewing, drafting and negotiating contracts and providing clearance review. Her transactional work includes advising art curators and collectors on commission agreements; artists on installation contracts, rights to create derivative works, copyright registration, insurance, and indemnification; filmmakers on licensing their work; and film non-profits on copyright, trademark, and right of publicity. She engages in pre-publication review, vetting books, films, plays, and other content to ensure all rights and clearances have been obtained and that the content contains no libel or privacy invasions. This includes reviewing releases, permissions and advising on fair use of copyrighted material.
Ms. Michelman-Dumas is on the Board of Directors of NewFest, NYC’s largest presenter of LBGTQ+ film and media. In this capacity she advises the Board on contracts and corporate agreements with partners like Amazon studios, HBO, Netflix, Buzzfeed, Gilead, as well as advising filmmakers on copyright, trademark, right of publicity issues, licensing, clearances and force majeure issues. She also advises on pre-litigation strategies in the intellectual property context.
In addition, Ms. Michelman-Dumas represents entrepreneurial clients in the hospitality, entertainment, and technology industries on general corporate and business transaction matters, and has advised charitable corporations regarding the preservation of 501(c)(3) tax-exempt status.
Her litigation experience spans eight years in high-stakes, multiparty civil and criminal proceedings.
She is fluent in Spanish, conversational in Portuguese, and reads Ladino and Medieval Spanish.
